Group sues Jacksonville and billboard company over St. Nicholas sign – Florida Times-Union
Apr 14A visual environment group is suing Jacksonville and billboard company CBS Outdoor Inc., arguing they violated a 1994 agreement restricting billboards in many parts of the city.
Scenic Jacksonville Inc. filed its case Wednesday in state Circuit Court. Neither the city nor the ad company has filed a response yet.
The group argues that a digital billboard CBS set up this year in the St. Nicholas area uses a bigger support structure than the agreement allows.
The group also questions the 2008 construction of a sign off Franklin Avenue by Interstate 95 near Clark Road on the Northside, quoting a city record that describes the sign as “too high.”
The group asks for the court to order “the removal of new billboards that have been erected as a result … of the city’s and CBS Outdoor Inc.’s failure to fully comply with the final judgment” of an earlier court case that required it to live up to 1994 agreement.
CBS Outdoor is the second company to construct digital billboards in Jacksonville. Scenic Jacksonville sued Clear Channel Outdor in 2010 over separate issues. The case is pending in state court.
